As far as i know you have yo manually assign a member to party leader after they are captured then freed. You only have the option to join as a vassal if you own land already. Merc is not possible.
Not sure there is any benefit in NOT doing that. Considering the feudal system wasn't exactly like Bannerlord's faction system. In Bannerlord becoming a vassal means basically becoming permanent part of a nation. In history vassals could enjoy various degrees of freedom. SO, I could only really find one reliable source thus far.
